T’s and C’s
- The promoter of the Competition is: Unit Road Creative Limited trading as Retroshite
- In these terms and conditions:
- references to we, us or our refer to Retroshite; and
- references to you, your or an Entrant) are to an entrant to the Competition.
- By submitting an entry to the Competition, you are agreeing to be bound by these terms and conditions.
- The Competition
- The Competition is a prize competition in which the prize will be the car (or vehicle) described on the Website as the prize for the Competition.
- The Competition requires every Entrant to demonstrate knowledge relating to a vehicle or the vehicle industry and therefore to exercise skill, knowledge or judgment to answer. The Competition requires every Entrant to answer a multiple-choice question or questions set by us for the Competition, each of which is intended to require the Entrant to demonstrate knowledge relating to a vehicle or the vehicle industry and therefore to exercise skill, knowledge or judgment to answer (a Competition Question). All Entrants to a Competition will be asked the same Competition Question(s). The answer to each Competition Question will be factual and correct on the basis of our research, and there will be one correct answer to each Competition Question.
- The winner will be selected at random from the Draw Pool using Google Random Number Generator. a live video recording on Retroshite Facebook page. A recording of that video will subsequently be available to view on the Website.
- An entry which gives an incorrect answer to a Competition Question will not be included in the Draw Pool. For the avoidance of doubt, the entry fee referred to in clause 5.1 shall still be payable by the Entrant and shall not be refunded.
- How to Enter
- Entries to the Competition may be submitted from the date and time specified on the Website (the Opening Date) until:
- the closing date and time specified on the Website; or
- All entries must be received by us by no later than the Closing Date. All entries received after the Closing Date will be automatically disqualified.
- In the case of a Website Entry (as referred to in clause 5.1), this means we must receive electronic notification of the entry having been made before the Closing Date.
- In the case of a Postal Entry (as referred to in clause 5.2), this means that the Entry must reach our address as specified in clause 3.5.2 before the Closing Date.
- In order to submit either a Website Entry or a Postal Entry, you must first create an online account on the Website (Website Account) and submit valid and accurate address, email and telephone details for yourself in connection with that Website Account. An entry will not be valid if an Entrant does not have a Website Account at the time of submission or the Draw.
- An entry may be submitted either:
- via the Entrant’s Website Account (a Website Entry) by paying the fee applicable to the Competition, as stated on the Website; or
- A Postal Entry must be made by sending a postcard to: Retroshite, 74 Wedderburn Street, Dunfermline, KY114PL The postcard must be headed ‘Retroshite’ with the following information:
- the Competition prize (so that we can identify the Competition to which your entry relates);
- the email address for your Retroshite.com Website Account; and
- your name, address, display name, telephone number and date of birth, all of which must match the details held for your Website Account. Please state that you have read and accepted the terms and conditions.
- When all details have been checked and verified, valid entries will be entered into the draw. The entry will be published online prior to the draw commencing.
- We will not accept entries that are:
- in any part generated by computer;
- completed by third parties or in bulk;
- illegible, have been altered, reconstructed, forged or tampered with;
- photocopies and not originals; or
- If an entry does not meet the requirements set out in this clause 3, it will not be valid and will not be considered for entry to the Draw Pool.
- We do not and will not accept:
- responsibility for Competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
- proof of posting or transmission as proof of receipt of entry to the Competition.
- Once submitted, an entry cannot be withdrawn and will not be returned.
- Entries for delivery are limited to one entry per postcard per competition.
- Entries to the Competition may be submitted from the date and time specified on the Website (the Opening Date) until:
- Eligibility Entrants must be at least 18 years old.
- In entering the Competition, you confirm that you are eligible to do so and eligible to claim the prize. Retroshite may require you to provide proof that you are eligible to enter the Competition.
- Entries on behalf of another person will not be accepted and joint submissions are not allowed.
- If there is any reason to believe that there has been a breach of these terms and conditions or that you have acted in a way which we reasonably believe may be unlawful, or if your conduct is contrary to the spirit or intention of the Competition, we may, at our sole discretion, reserve the right to disqualify your entry and/or exclude you from participating in the Competition.
- Any person who attempts to make an entry from outside Great Britain must ensure that he or she is not contravening the law of that country. We cannot accept any responsibility for any breach of the law by an entrant in such circumstances, which are beyond our control. The Entrants and the Promoter recognise that the Competition, its administration and all associated activities are governed by Scottish Law. They recognise that the County or High Courts of Scotland shall have exclusive jurisdiction in the event of any dispute arising our of the Competition or its administration.
- All written communication must be presented in block capitals for clarity.
- The Prize
- The prize is a vehicle of the make, model, year and condition as described on the Website in connection with the Competition (the Vehicle) and there is one such Vehicle available to be won.
- If the Prize results in any overseas travel; all costs and paperwork relating its legality is the responsibility of the winner.
- Any costs and logistics relating to travel beyond UK mainland is the responsibility of the winner.
- In the event of collection, the Vehicle will be available for collection from Ky48HJ (the Premises) following the Draw during normal office hours.
- The description of the Vehicle on the Website may indicate that the Vehicle is not currently roadworthy or does not have an MOT (if one is required). In this case, the winner will not be able to drive away the Vehicle.
- The prize does not include any road tax or insurance for the Vehicle, which will need to be arranged by the winner.
- We do not provide any warranty or guarantee for the Vehicle.
- Any costs that are incidental to the fulfilment of the prize, including collection or transportation costs of the Vehicle or its tax or insurance, are the responsibility of the winner.
- The prize is not negotiable or transferable.
- Although every care is taken in our workshops, the cars are classic and therefore not new, they may come with faults.
- Winners
- The result of the Draw, as announced by Retroshite, will be final and we will not enter into any discussion or correspondence about the decision with any Entrant who is not the winner.
- Retroshite will contact the winner personally as soon as practicable after the Draw, and in any event with 7 days, using the telephone number and/or email address provided by the winner for their Website Account. Entrants are solely responsible for providing contact details which are/will be correct at the time of the Draw and for at least 7 days following the Draw and we will not amend any contact information for an Entrant once an entry has been submitted. If the contact details are incorrect such that we cannot make contact with the winner by telephone or email, the Draw will be re-run and a new winner will be selected. If we are not able to make contact with the competition winner within 7 days of the Draw, we reserve the right to re-run the draw to find a new winner. The original winner who supplied incorrect contact details will have no claim to the prize.
- Winners’ Publicity
- If you are the winner, you authorise retroshite to publish your name and county on the Website following the Draw in order that we may comply with the CAP Code (UK Code of Non-broadcast Advertising and Direct & Promotional Marketing) and any legal requirements and also for publicity and marketing purposes. If you object to such information being published in this way, please contact us using the contact details below in clause 1. Notwithstanding any objection, you recognise that Retroshite may still be required to give your name, county and winning entry to the Advertising Standards Authority on request.
- If you are the winner, you also agree to allow Retroshite to take and to use, for publicity and marketing purposes, a photograph and/or a video (Media) featuring you with the prize and you agree that:
- Retroshite has permission to publish the Media on its Website and other marketing materials for publicity purposes in any country; and
- you do not object to Retroshite storing copies of the Media for as long as necessary for these purposes.
- Retroshite will be the controller and responsible for any personal data comprising the Photograph and your contact details.
- Claiming the Prize
- If you are the winner, you must do the following in order to claim the prize:
- answer or respond to our telephone call or email to you (referred to in clause 2) within 7 days of the Draw; and
- Collect the prize from our premises in Fife ky48hj, the winner must produce photo identification (a passport or UK driving licence) which matches the details we hold for your entry and Website Account.
- The Vehicle cannot be collected by a third party (e.g. a car transportation company) on your behalf unless we specifically agree to this in advance
- The car must be taken off the Premises at the time of collection unless we agree otherwise and you agree to pay any storage costs we specify.
- We will transfer the prize to a winner by completing the vehicle logbook (V5) with the winner at the Premises at the time of collection.
- If you do not meet the requirements set out in this clause 8 within the relevant time period(s) specified your claim may be invalid and we may re-run the Draw or the Competition, at our discretion. We do not accept any responsibility if you are not able to take up the prize in these circumstances.
- For the avoidance of doubt, in the event that the Draw is re-run, the original winner will no longer have any claim to the prize, and these terms and conditions will apply to the new winner as if he/she was the first winner selected in the Draw.
- If you are the winner, you must do the following in order to claim the prize:
- Limitation of Liability
Insofar as is permitted by law, we, our agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by our negligence or that of our agents or distributors or that of their employees. Your statutory rights are not affected.
- Data Protection
We will process your personal information as set out in our privacy policy. Please also see clause 7, with regard to the announcement of winners.
Refund Policy
Entries to the Competition are final and no refunds shall be made at any time or for any reason, except in the case of entries submitted after the Closing Date or if the competition gets cancelled.
No refunds of the entry fee will be given in any event, including; (a) if, following your entry into the competition, you subsequently find out that you are not eligible to enter the competition or claim the Prize; (b) if, following your entry into the competition the eligibility criteria for entering the competition or claiming the Prize changes and you are no longer eligible; or (c) if you are disqualified from the competition by the Promoter for any reason. Entrants can enter the competition as many times as they wish until the maximum number of entries have been received. Entrants submitting free entries must submit each entry separately. Bulk entries, if received, will not be accepted and will only be counted as one single entry.
